TERMS & CONDITIONS

 

Article I.         Your Training Weekend

When You (the Client) make a booking and Emma Bilham (the Organiser) accept it, a legally binding contract is made. When you sign the booking form or fill one in online, you (and any other person on whose behalf you book) agree to accept all of the conditions stated within this document and the booking form.

Section 1.01      Schedule

The triathlon camp with be held from 18-19 June 2022. You will receive a detailed program a few weeks out from the event. Details are also available at Wheelworx Bike & Triathlon Store, Fonthill/Dublin.

Section 1.02      Special Requests

The triathlon camp is a group event and the wishes of all participants will be considered by us on an equal basis. If you have any special requests, please inform us when you make your booking. We will attempt to accommodate any special requests but cannot make any guarantees.

Depending on activities, the group will be split for practical and safety reasons. If at any stage you do not feel confident participating in an activity, please inform us immediately to reduce the risk of accidents to yourself and others. Group division is at the discretion of the organisers.

Section 1.03      Accommodation / Route

Every care has been taken to plan the activities and accommodation. However, local conditions such as road works, weather or events may require us to change the activities at short notice. We reserve the right to alter the activities or schedule as required.

Section 1.04      COVID-19 measures

We will ensure all recommended health measures in place at the time of the camp, including social distancing, use of masks and sanitary procedures, are scrupulously followed.

Section 1.05      What’s included

(a)     Accommodation

The full triathlon weekend includes accommodation in a selected hotel guest on a basis of 2 people sharing a room. If you require a single room, this must be indicated during the booking. Room occupancy cannot be altered at short notice. An extra charge will be levied for single room occupancy.

A option without accommodation is available.

(b)     Support Vehicle

A support vehicle shall be provided during the Ironman course ride. The vehicle will not accompany the group all the time but will be available at various locations throughout the ride. The support vehicle is available for anyone wishing to stop early, however please not spaces are limited.

(c)      Meals

When booking the full weekend, the following meals are included: Saturday lunch, Saturday dinner, Sunday breakfast and Sunday picnic lunch. When booking the option without accommodation, the following meals are included: Saturday lunch, Sunday picnic lunch. Saturday dinner is possible at additional cost on request.

Section 1.06      What’s not included

(a)     Insurance

Any insurance which you require is not included. This includes travel, accident, health, 3rd party or cancellation insurance. We cannot be held liable for any accidents that may occur during the weekend. By signing up for the weekend you accept full responsibility for any adverse event.

(b)     Bicycle & equipment

We do not provide bicycles although we can arrange bicycle hire should you require it. If you would like to hire a bicycle please inform us no later than 4 weeks before the scheduled start of the camp. The cost of hiring a bicycle is not included in the tri camp price.

Additionally, we cannot provide any open water swimming equipment such as wetsuit and goggles or running shoes.

(c)      Spare Parts

The support vehicle will contain some spare parts (e.g. chains, tires). We reserve the right to charge for any of these spare parts you consume.

(d)     Extra Activities

The camp does not include any extra activities beyond those indicated on the provided schedule. Should you take part in any activity outside of those organised by us, we have no liability or responsibility for you during that activity or for your contract with that activity provider.

You are not entitled to a full or part-refund if you have to cancel or withdraw from the camp as a result of any injuries which you sustain during an activity which is not part of the camp organised by us.

(e)     Travel to/from camp destination

The camp does not include your transport to/from Youghal.

 

Article II.       Your Commitment

Section 2.01      Ability to Participate

By accepting this contract you confirm that you are mentally and physically capable of completing the camp. Any existing medical condition or disability susceptible to affect your participation must be announced at the time of booking. We reserve the right to refuse your booking if, in our reasonable opinion, we consider your condition or disability unsuitable for the enjoyment and completion of the triathlon camp. Should medical problems be discovered during the camp, we reserve the right to cancel the contract. Refer to Section 8.02 Premature Termination for details on your rights to a refund and compensation.

Section 2.02      COVID-19 Symptoms

In respect to Section 2.01 Ability to Participate, we ask that you do not participate in the camp if you present any symptoms related to the current coronavirus situation, including but not limited to a high fever, coughing, sore throat, shortness of breath etc., if you have presented a positive test in the last 7 days or been in close contact with a positive individual in the last 10 days. Please refer to Section 6.02 If you Cancel for details of your rights to compensation.

Section 2.03      Guide Authority

Entering into this contract commits you to abide by the authority of the camp organisers and their representatives. The decision of the guides & representatives as to the conduct, itinerary and objectives of the camp is final. If, in the opinion of the guide or representative, your behaviour or physical condition is detrimental to the safety, welfare and well-being of the group as a whole (which are the paramount considerations), or if the guide or representative considers your general wellbeing will be put at risk by continuing with a particular activity or the entire camp, you may be asked to leave without the right to any refund.

Section 2.04      Guide Responsibility

The guides are not responsible for your safety during the camp, including but not limited to the cycling, open water swimming and running activities. Activities take place on open roads and you are subject to the national and local rules of the road. The guides are not responsible for ensuring that you are aware of the rules of the road or that you obey the rules of the road. Do not blindly follow the guides or other participants into junctions without checking the traffic situation.

There will be no pressure to ride beyond your capabilities. You are responsible for your safety at all times during the camp. You are obliged to inform the guides if you do not feel confident during the camp or feel under pressure to ride beyond what you consider safe.

Section 2.05      Helmet

You must wear a helmet at all times when cycling. All helmets must adhere to the latest safety standards (e.g. EN1078). Not wearing a helmet when riding will result in an immediate exclusion from the camp without the right to any refund.

Section 2.06      Alcohol

Partaking in any one of the sports activities when under the influence of alcohol is forbidden. Please ensure that alcohol consumption in the evening will not impair your athletic ability the next day. If you feel unable to participate in an activity please inform us immediately.

Section 2.07      General Behaviour

The activities will be held on open roads or in open water conditions. We request appropriate behaviour between participants and to members of the public. Even though some situations with other road users may be stressful we will not tolerate any insulting behaviour towards them or members of the group. This includes shouting or inappropriate gestures. Inappropriate behaviour can lead to an immediate, non-refundable exclusion from the camp.

Section 2.08      Damage caused by you

You are liable for all damage caused by you. You must immediately report any damage to the owner of the property and to a guide. We are not responsible for the resolution of any claims made by you or against you. These are to be resolved directly between you and the 3rd party.

Section 2.09      Injury to others caused by you

You are liable for all injuries caused by you to others. You must immediately report any incidents to a guide. We are not responsible for the resolution of any claims made by you or against you. These are to be resolved directly between you and the 3rd party.

Section 2.10      Image Rights

Any likeness or image of you secured or taken during the camp may be used by us without charge in all media (whether now existing or in the future invented) for bona fide promotional materials of any kind, such as brochures, websites, slides, video shows and the internet. Please inform us if you wish to refuse this before attending.

 

Article III.      Price & Payment

Section 3.01      Price

The camp price and currency are indicated on the online booking form and at Wheelworx Bike & Triathlon Store, Fonthill/Dublin. Discounts may be offered depending on group rates and season. If you are eligible for a discount this will be indicated on the booking form or when booking at Wheelworx Bike & Triathlon Store, Fonthill/Dublin.

Section 3.02      Transfer Fees

Any costs you incur in the payment of the camp price (e.g. bank fees, exchange rate fees) are to be carried by you and are not deductable from the total camp price.

Section 3.03      Payment

Your place on the camp is only accepted by us when we have received both the submitted booking form and complete payment. Online payment is handled through a secure platform. Accepted online payment methods accepted are: credit card, PayPal.

Cash or credit/debit card payment are also accepted at Wheelworx Bike & Triathlon Store, Fonthill/Dublin.

 

Article IV.      Significant Contractual Changes

Section 4.01      Definition

A significant change to the contract is defined as being a major change to a key point within this contract which we make before the start of the camp. Significant changes include:

  • Duration of the camp

  • Start/End Dates

A change in schedule or accommodation does not constitute a significant change.

Section 4.02      Our Obligations

If we make a significant change to the contract we will inform you as soon as possible.

Section 4.03      Your Rights

If we make a significant change, you may accept the change or exercise your right to cancel the contract. If you cancel the contract because of a significant change you are entitled to:

  • Receive a full refund of all monies paid.

  • Participate in a camp from us of the same value or higher value if we are able to offer such.

  • Participate in a camp from us of lower value together with a reimbursement of the price difference if we are able to offer such.

You must inform us of your decision as soon as possible and without delay.

Your rights to compensation in case the contract is not fulfilled remain unaffected.

 

Article V.        Minimum Participants

The camp will only take place if the minimum number of 15 participants is reached. If the camp is cancelled due to lack of participants you will be informed 4 weeks before the scheduled start of the camp. A full refund of monies paid will be made.

We will send you a confirmation that the camp will take place when the minimum number of participants have confirmed their participation and paid their deposit.

We do not advise to make any travel arrangements before you have received confirmation from us that the camp will take place. We cannot be held liable for any losses for flights or other costs which you may incur should we cancel the camp.

 

Article VI.      Cancellation

Section 6.01      If we cancel

If we cancel the camp for a reason for which you are not responsible or a reason listed below, you are entitled to a refund or similar camp as defined in Section 4.03 Your Rights.

(a)     Cancellation due to Minimum Participants

You are entitled to a full refund but not to compensation for non-fulfilment or partial fulfilment of the contract if we cancel because we do not have the minimum number of participants as defined in Article V Minimum Participants and we inform you within the time period defined within that section.

(b)     Cancellation due to Force Majeure

We will not pay you compensation if we have to cancel or change your travel arrangements in any way because of war, riot, industrial dispute, terrorist activity, natural or nuclear disaster, fire, adverse weather conditions or other unforeseen circumstances such as COVID-19 restrictions that may amount to force majeure.

Section 6.02      If you cancel

You may cancel your travel arrangements at any time. We require written confirmation of your cancellation. Cancellation charges as shown below will be applicable. You are liable for the cancellation charges regardless of whether you have already paid the camp price or not.

  • Cancellation up to 8 weeks before the start of the camp:

    you are entitled to 75% refund.

  • Cancellation up to 6 weeks before the start of the camp:

    you are entitled to 50% refund.

  • Cancellation less than 4 weeks before the start of the camp:

    you are entitled to 25% refund.

(a)     Cancellation due to personal case of COVID-19

Should you test positive for COVID-19 before the start of the camp, you are entitled to a 50% refund.

 

Article VII.    Inability to Participate

Section 7.01      Transfer to another person

If you are unable to participate in the camp, you have the right to transfer your booking to another person who fulfils all the conditions of participation. You must inform us of your inability to participate and your transfer of your booking to another person no less than 2 weeks before the start of the camp.

You and the other person share liability together for the payment of the camp price and any costs which we incur as a result of the transfer to another person.

We reserve the right to charge a re-booking fee of EUR 50.00 in case of a transfer of your booking to another person.

Section 7.02      No-show

If you do not turn up for the camp you will not be entitled to any refund of monies paid to us or compensation.

If your arrival is delayed we will do everything to ensure that you are able to participate in the camp within reason. You are however responsible for ensuring that you are able to arrive at the correct time and any potential delays are considered in your travel planning.

If you are refused entry to Ireland, refused exit from your departing country, detained at the airport or otherwise restricted in your travel you will not be entitled to any refund or compensation.

You may be liable for any costs incurred by us as a result of your absence or delayed arrival.

 

Article VIII.   Abandonment

Section 8.01      Inability to participate in activities

If you are unable to complete the cycling part of the camp we will transport you without any extra charge in the support vehicle.

If you cannot continue because of a defect on your bicycle we will do everything possible to repair your bicycle, or assist you in getting it repaired. However, the support vehicle is primarily for the support and safety of the riders and this role has priority.

If you are unable to participate in the cycling but continue the camp you shall not be entitled to a refund or any compensation. We are not liable to provide any alternative accommodation or activities.

Section 8.02      Premature Termination

If you have to terminate your camp for any reason, you will not be entitled to a refund for any services which you have not used or compensation. Any extra costs which you incur (e.g. accommodation or meals) which are not part of the contractual services must be paid for by you.

 

Article IX.      Non-/Partial- Contract Performance

If the present contract is not performed or is improperly performed by us or our suppliers we will pay you appropriate compensation if this has affected the enjoyment of your travel arrangements. However, we will not be liable where any failure in the performance of the contract is due to: you; or a third party unconnected with the provision of the travel arrangements and where the failure is unforeseeable or unavoidable; or unusual and unforeseeable circumstances beyond our control, the consequences of which could not have been avoided even if all due care had been exercised; or an event which we or our suppliers, even with all due care, could not foresee or forestall.

Section 9.01      Claims

You must communicate any failure in the fulfilment of the contract which you identify in-situ as soon as possible in written or other suitable form to us.

In case of a claim for non- or partial contract fulfilment, we will undertake everything possible to find a suitable solution for you.

Section 9.02      Liability

We are responsible to you for the proper performance of the obligations under the contract, irrespective of whether such obligations are to be performed by us or by other suppliers of services.

The compensation for damage from non-performance or inappropriate performance of the contract is subject to the limitations provided for in international agreements.

We are not liable to provide compensation for non-performance or inappropriate performance of the contract when:

  • It is caused by you

  • It is caused by unforeseeable or unavoidable actions of a third party which is not part of providing the services defined in the contract.

  • It is caused by force majeure which we despite all care could not foresee and avoid.

In the last two cases, we will do everything in our power to assist you in any difficulties which arise as a result of the non-performance or inappropriate performance of the contract.

Our liability in cases involving personal injury is not limited within this contract. For other damage, our liability is limited to twice the price of the camp, except for intentional or grossly negligent inflicted damage.

Section 9.03      Complaints

If you have a complaint during your camp, you must inform one of the guides so that matters can be resolved immediately. If the matter cannot be put right straight away you must ask the guide for a complaint form which must be completed in their presence. A copy will be given to you. If you are still dissatisfied, we ask you to write to us within 5 days of the camp.

 

Article X.        Pass & Visa Requirements

You are responsible for ensuring that you have the correct travel documents if you are entering Ireland from abroad. We cannot accept responsibility for any delays or expense incurred through irregularities in your documents.

 

Article XI.      Health Requirements

You are responsible for ensuring that you have met any compulsory health requirements for entry to Ireland, including all current COVID-19 requirements. You are responsible for any insurance you may require or want. You must ensure that you have means to pay for any assistance, treatments or medication you may require. We cannot pay for any assistance, treatments or medication or loan money for such. Your formal health requirements such as insurance depend upon your country of residence. Article XII.    Insurance

Before participating in the camp you must ensure that you have taken out adequate insurance for travelling abroad (if applicable) and taking part in cycling activities. The insurance should cover, including but not limited to, your medical expenses, repatriation, cancellation etc.

We do not check insurance policies. We reserve the right to cancel your booking at any time before the start of the camp if we are not satisfied that adequate insurance is in place for you. You accept sole responsibility for all baggage and personal effects, including bikes, at all times. We cannot be held be responsible for any loss, damage or accident to any luggage and property, howsoever incurred. You are advised to check the limitations of your insurance policy in this respect.

 

Article XIII.   Exclusion

You can be immediately excluded from the camp without a refund or rights to any further services or products from us, including accommodation and transport if:

  1. You do not wear a helmet when riding.

  2. You endanger the guides, camp participants or 3rd

  3. You do not respect the guides’ authority.

  4. You willingly cause damage to guides, participants or 3rd party property.

  5. You act in such a way to bring the organisation into disrepute.

  6. Your health may be damaged by continuing.

  7. You break any laws of the land.

 

Article XIV.   Regulations and Jurisdiction

These terms and conditions comply with the “Council Directive 90/314/EEC of 13 June 1990 on package travel, package camps and package camps[1] as implemented in Swiss law[2] according to the “Bundesgesetz vom 18. Juni 1993 über Pauschalreisen” / “Loi fédérale du 18 juin 1993 sur les voyages à forfait” (No. 944.3).

Your contract with us and any matters arising from it shall be subject to Swiss law. The place of jurisdiction is Montreux, Vaud, Switzerland.
